Terms of Service
Effective date: 29 September 2026
These Terms of Service (“Terms”) govern your use of ips-session, a photographer-led client viewing, sales, and ordering platform operated by Bookowl Software (“we,” “us,” or “our”). By creating an account or using ips-session, you agree to these Terms. If you use the service for a business, you confirm that you have authority to agree on that business’s behalf.
1. The service
ips-session helps photography studios present images, manage client galleries and selections, configure products, prepare orders, and record related information. Features may vary by plan and may change as the service develops.
Your studio—not Bookowl Software—is responsible for its relationship with its clients, including its prices, products, fulfilment, client-facing terms, taxes, and any payments it records as received. An order or electronic signature created through ips-session does not make Bookowl Software a party to your agreement with your client.
2. Accounts and access
You must provide accurate account information, keep your sign-in details secure, and promptly tell us at support@ipssession.com if you suspect unauthorised access. You are responsible for activity under your account, except to the extent caused by our failure to meet an obligation that cannot lawfully be excluded.
You must be at least 18 years old to create an account. You are responsible for ensuring that anyone you permit to use your studio account is authorised to do so and follows these Terms.
3. Your content and client information
You retain ownership of the photographs, designs, text, client details, and other material you provide to ips-session (“Your Content”). You grant us a limited right to store, process, display, resize, and transmit Your Content only as needed to operate, secure, support, and improve the service, and to carry out actions you request, such as generating galleries, orders, or exports.
You confirm that you have the rights and permissions needed to upload and use Your Content and to provide us with client information. You are responsible for giving your clients any notices and obtaining any consents required for your use of their photographs and personal information. You must not upload unlawful material or material that infringes another person’s rights.
Our handling of personal information is described in the Privacy Policy. You should retain your own copies of important photographs and business records; ips-session should not be your only copy.
4. Acceptable use
You must not use ips-session to break the law; infringe intellectual property or privacy rights; upload malware or harmful content; interfere with the service or another user; attempt unauthorised access; or use automated extraction or excessive requests that disrupt the service. You must not misrepresent an order, payment, or client consent recorded in the platform.
We may take proportionate steps, including restricting access to specific content or suspending an account, when reasonably necessary to address misuse, security risks, or a legal obligation. Where appropriate, we will give you an opportunity to address the issue.
5. Trials, subscriptions, and payment
The current free trial lasts 14 days, requires no payment card, and stops without automatically starting a paid subscription. A paid monthly or yearly plan begins only when you choose one and complete checkout.
Paid subscriptions renew for their selected billing period unless cancelled. The applicable price, currency, taxes, billing interval, and any optional add-on charges are shown before you complete checkout. Subscription payments are processed through Stripe; we do not need your full payment-card details to operate your studio account.
You can request cancellation through the account’s billing controls. Cancellation stops future renewal, and access ordinarily continues until the end of the paid period. Cancelling does not itself refund a period already paid for. Refunds, credits, and remedies remain available where required by applicable law or expressly offered at checkout. If a payment fails, we may ask you to update your payment method and may restrict paid access after reasonable notice.
We may change prices for future billing periods. We will give reasonable advance notice of a price increase affecting an existing subscription and explain how to cancel before it takes effect.
6. High-resolution features
High Res Export is an optional paid-plan add-on and is not included in the free trial. Its availability depends on your current entitlement. Activating it does not restore high-resolution originals for photographs previously uploaded in compressed form. You are responsible for keeping original files where you need them for production or delivery.
7. Client orders and electronic records
ips-session can help your studio prepare orders, record payments received, and capture typed electronic agreement to client-facing terms. You are responsible for checking each order and payment record for accuracy and for deciding whether your own client terms and signing process meet the requirements of your business and applicable law. We do not guarantee that a particular order, signature, or document will be enforceable in every circumstance.
8. Availability and changes to the service
We aim to keep ips-session available and secure, but we do not promise uninterrupted or error-free access. Maintenance, outages, third-party services, and events outside our reasonable control may affect availability. We may update or discontinue features, but will give reasonable notice before making a material change that substantially reduces a paid feature you are using, where practicable.
9. Cancellation, account deletion, and data
After paid access ends, studio data is ordinarily retained for 60 days before it is scheduled for deletion. You may be able to restore access by resubscribing during that period. You should export any information you need before access ends. Account deletion is a separate action and may begin deletion sooner; the ordinary 60-day retention period does not apply to an account-deletion request.
Deletion from active systems may take time to complete. We may retain limited records where required for legal, tax, security, dispute-resolution, or billing purposes, as explained in our Privacy Policy.
You may stop using the service at any time. We may suspend or terminate access for a material breach of these Terms, non-payment, or a serious security or legal risk. Where reasonable, we will notify you and allow you to remedy a breach before termination.
10. Our intellectual property
Bookowl Software and its licensors retain their rights in ips-session, including its software, design, branding, and documentation. Your subscription gives you a limited, non-exclusive right to use the service while your account is active, subject to these Terms. It does not transfer ownership of the service or of Your Content.
Third-party material made available through a feature, including music or other licensed assets, may have separate usage restrictions. You must follow any restrictions presented with that material.
11. Australian consumer rights and liability
Nothing in these Terms excludes, restricts, or modifies a right, guarantee, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Subject to those non-excludable rights, neither party is liable to the other for indirect or consequential loss, such as lost profits or business opportunities, to the extent permitted by law. To the extent permitted by law, our total liability arising from the service is limited to the fees you paid us for ips-session in the 12 months before the event giving rise to the claim, or AUD $100 if you paid no fees. This limit does not apply where the law prohibits it, or to liability for fraud or wilful misconduct.
12. Changes to these Terms
We may update these Terms to reflect changes to the service, the law, or our business practices. We will publish the updated Terms with a new effective date and give reasonable notice of material changes where practicable. If a material change adversely affects you, you may stop using the service and cancel your subscription before the change takes effect, subject to any rights you have under applicable law.
13. Governing law and contact
These Terms are governed by the laws of New South Wales, Australia. Subject to any mandatory rights or jurisdictional rules that apply, disputes may be brought before the courts of New South Wales.
Questions about these Terms can be sent to support@ipssession.com.
